Comelec: Recount promulgation set on Friday
CITY OF SAN FERNANDO --- The Commission on Election (Comelec) Second Division headed by Commissioner Nicodemo Ferrer is set to promulgate their resolution for the result of the recount process filed by former Board Member Lilia G. Pineda against Governor Eddie Panlilio on Friday.
It can be recalled that Pineda has filed an electoral protest a few days after Panlilio was proclaimed winner in the 2007 elections with a margin of 1,147.
Pineda claimed that ‘Nanay votes’ were not counted during the 2007 polls hence, she filed for a recount before the Commision on election.
Earlier the Comelec Second Division junked a petition by Panlilio to stop the creation of 21 committees to conduct a recount of the votes cast in the gubernatorial elections in Pampanga.
The Comelec 21 committees had pushed through the recount process and now after more than two years, the Second Division is now ready to promulgate the result of the recount process and announce the real winner in the 2007 gubernatorial race in the province on Friday.
As this developed, Ferrer, said they will file charges of contempt of court against Atty. Ernesto Francisco, one of the lead counsels of Panlilio in the recount process.
Ferrer said the act of Francisco of disclosing to the media their motion for inhibition before submitting it the office of the Comelec is ‘contemptous.’
“Kaya nga mayroon kaming account ng mga oras at araw na ginawa ito ni Francisco, huwag niya akong susubukan. Hindi tama ang ginawa ni Francisco, we will give him a dose of his own medicine,” Ferrer said in an exclusive interview yesterday.
Asked if what would they do with the motion, Ferrer said they would categorically deny the motion as it is too late because we are on the process of making and announcing the result.
Ferrer said “nobody can stop us from promulgating the resolution for the recount process as he said that they are now in the finishing touches of making a resolution.
Reports have it that a week before the expected decision on the poll protest filed by Pineda, Panlilio last Friday had asked the Comelec to replace the commissioners assigned to decide the case.
“Anong gusto niyang gawin naming sirain ang recount process mula sa simula?” Ferrer asked
In his urgent motion, the governor asked the commissioners of the second division to inhibit themselves from the case as he accused Ferrer of extreme bias in handling the recount process.
“Buti pa si Atty. Sixto Brilliantes, lead counsel ni Panlilio ay hindi lumagda doon sa motion kasi alam niya at nakita nila ang proseso,” Ferrer said.
Ferrer maintained that his conscience is clear. He said the hearings were transparent and even the local media were invited. "I decided cases in demerits. Nobody has come here for this case. Nobody from MalacaƱang came here,” Ferrer. (Joel P. Mapiles)
